Significant conditions in bonus advertising

An advertisement is often the first place a person decides whether an offer is relevant. Important restrictions should not be hidden until after that decision has prompted registration or payment.

The key points
  • Ask what changes the decision
  • Read prominence as well as presence
  • Separate advertising complaints from money claims

Ask what changes the decision

Eligibility, qualifying deposits, payment exclusions and deadlines can be material. Imagine reading the headline without each condition in turn: would the omission change your understanding of the offer? This is a useful practical test, although a formal advertising assessment depends on the whole communication and applicable rules.

Read prominence as well as presence

A restriction can exist somewhere on a page but still be difficult to notice. Small print far below a button is not the same presentation as a clear condition beside the headline. Save a full-page view where possible so that a complaint preserves placement as well as wording.

Separate advertising complaints from money claims

The ASA deals with advertising standards. An operator complaint or ADR route may be needed for a transaction dispute. You may have more than one concern, but describe each separately: misleading presentation, missing information and a withheld balance are different issues with different evidence.

Assess the whole presentation

A condition can be technically present yet practically separated from the decision it affects. Consider the headline, button placement, screen size and path to full terms. On a phone, a reader may see a large reward and action button long before the restriction. A useful evidence record captures that sequence without requiring you to complete registration or payment. Record the URL and date, and distinguish what was visible immediately from what required another click. This is more precise than saying the terms were hidden without showing how. If a promotion is sent by email or message, preserve the original communication as well as the landing page because each may present different information. Advertising clarity and contract application remain related but distinct questions.

  • Identify which omitted or unclear condition would have changed the decision to register, pay or participate.
  • Capture enough of the page to show prominence and context rather than cropping only the disputed words.
  • Direct advertising concerns and requests for a monetary remedy to the appropriate routes, retaining the shared evidence for both.

The hidden payment exclusion

An invented banner says deposit £10 for a reward, while a payment exclusion is buried at the bottom. A customer using the excluded method may reasonably need that information before paying. Preserve the banner, the exclusion and the deposit record if disputing the result.

Common questions

Does a link to full terms always make an ad clear?

No. Significant conditions may need prominence in the advertisement itself. A link is not a universal cure for a misleading headline.

What if the account behaves differently from the explanation?

Stop and save the relevant screen, terms and transaction references. Ask for a written reconciliation. Continuing to gamble is not necessary to investigate an unclear promotional rule.
